Article 1: Purpose
This contract is intended for the exclusive use of booking overnight stays or stays in the guest room(s) Le Surmelin – Alain Deloore.
The owners undertake to personally look after their tenant(s), from the beginning to the end of their stay, in terms of welcome, meals if any, comfort and tourist advice for the discovery of the region.
Breakfasts are included in the bed and breakfast service and are not deductible if not consumed.

Article 2: Duration of stay, arrival and departure
The client who signs this contract, concluded for a fixed period, may not under any circumstances take advantage of any right to remain in the premises.
Unless otherwise agreed, the tenant must arrive on the day specified at the times (slot) mentioned on this contract.
In case of late arrival, the tenant must imperatively inform the owners. If no news from the tenant before 7pm, the contract will be void and the owners will be entitled to re-let the accommodation. A delayed arrival towards the next day is not possible.
In case of early arrival, the client must also inform the owners to ensure their presence and availability.
On the morning of departure, the tenant undertakes to leave the rented premises at the time specified in this contract.
In the event of prolonged use of the premises on the day of departure and with the agreement of the owners, a late departure supplement may be charged to the tenant.

Article 3 : Booking and conclusion of the contract
Reservations can be made via the reservation module on the website www.surmelin.com or their Facebook page or by email to alain@surmelin.com
The reservation is considered firm only after receipt of a deposit cashed on our bank account and deductible from the invoice on your arrival, and on receipt of an email of good reception with the details of the service booked, having value of contract.
The deposit must be paid or paid by credit card (PayPal or SumUp) within 5 working days from the date of the reservation request.
The amount of the deposit is :
In the case of a direct booking with the owners: for 1 night: the total amount of the stay. For other stays: 30% of the total price of the stay.
In the case of a reservation via one of the reservation sites: see the reservation site concerned.

Article 4 : Cancellation by the client
All cancellations must be notified by e-mail to the owners.
For cancellations made more than 30 days before the scheduled arrival date, the deposit paid as a reservation guarantee is retained by the guest house as a forfeit in accordance with the provisions of article 1590 of the Civil Code.
For any stay cancelled less than 30 days before the planned arrival, shortened, delayed arrival, reduction in the number of rooms or no-show, the full amount of the stay as provided for in the booking confirmation will be due (article 1590 of the Civil Code).
If the client cancels via the booking site, see the relevant booking site and its conditions.

Article 5: Cancellation by the owner
When the owners cancel the stay before the beginning of the stay, for reasons beyond their control, they must inform the client as soon as possible by telephone or e-mail. The client will be reimbursed immediately for the sums paid.

Article 6 : Arrival time
The client must arrive on the day specified in the reservation and at the times mentioned on the reservation confirmation. The rooms are available from 4 p.m. onwards. Please inform us in case of arrival after 9 pm.

Article 7: Check-out time
Rooms must be vacated by 10:00 am at the latest. After 10.45 a.m., an additional night will be charged.

Article 8 : Cancellation insurance
The owners draw the attention of the client to the fact that no cancellation insurance is included in their rates.

Article 9 : Payment of the balance of the accommodation
The balance of the stay must be paid on arrival. The balance can only be paid by credit card or by Paypal.
Additional services not provided for will be paid at the end of the stay.

Article 10: Tourist tax
The tourist tax is a local tax that the client must pay to the owners who then pay it to the Treasury. It contributes to the development of tourism in the South Aisne. The amount varies according to the classification or labeling of the accommodation. It is charged to people over 18 years old and per night. For our establishment it is fixed at 0,66 Euros per person of age and per night and is included in our nightly rates.

Article 11: Change of rooms
Without the client being able to claim any compensation, the owners reserve the right to change the room initially booked by the client for a room of the same or higher capacity. In this case, the cost of the reservation remains unchanged.

Article 12: Capacity
The reservation is made for a specific number of persons. If on the day of arrival, the number of occupants is higher, the owners are able to refuse the additional persons. This refusal can in no way be considered as a modification or breach of contract on the owners’ initiative, so that in the event of the departure of a number of people greater than those refused, no reimbursement can be envisaged.

Article 13: Breakfast is served from 8am to 9.30am. It is included in the nightly rate and is not refundable.

Article 14: Pets
The present contract specifies that pets are allowed provided that:
they are announced at the time of booking and confirmed by the owners.
they stay in the assigned rooms.
they sleep in a basket and not on the bed.
The owners have the right to charge a deposit of €50 for extra cleaning.
If the guest shows up with a pet that has not been announced, the owners have the right to break the contract and to claim the balance of the stay.

Article 15 : Art of living, use of the premises
The respect of a certain art of living is required from all guests to guarantee the quietness of the place and the comfort of its guests.
It is requested not to smoke and not to vapourise inside the house, the rooms and the common areas (including the terrace) and to keep away from open doors and windows in order not to inconvenience the occupants.
The client undertakes to return the rooms in perfect condition at the end of the stay and to declare, and assume financially, any possible damage for which he/she could be responsible.
Children staying at Le Surmelin are under the sole responsibility of their parents. They are not allowed to enter the private areas.
It is forbidden to take meals in the rooms or to use the kitchen to prepare them.
It is forbidden to organise parties as such.
Between 10 p.m. and 7.30 a.m. it is strictly forbidden to make noise or to use the common areas.

Article 16: Services
Le Surmelin has a secure WIFI network with 3 access points. We cannot guarantee the stability, permanent availability and constant speed of the internet network (1Gb fibre). We have the right to restrict or close the internet access in case of abuse.
Breakfast consists of a cup of coffee, milk or tea, half a baguette, croissant and the day’s fillings. The range may vary according to availability.
The table d’hôtes is only available on prior reservation and after confirmation of the menu. Only because of allergens it is possible to change the menu.

Article 17: Data processing and freedom
In accordance with the law of January 6, 1978 relating to data processing, files and freedoms, you have the right to access and rectify data concerning you. Alain Deloore undertakes not to transmit the information you have provided to other companies or organizations.

The present conditions of sale are subject to change at any time without notice. Acceptance and compliance with these terms and conditions of sale are deemed acquired upon payment of the deposit.

Le Surmelin and its services do not intend to collect data on persons under the age of 16 unless they have permission from parents or guardians. We can not check if a visitor is older than 16. Le Surmelin makes no decisions based on automated processing on matters that may have consequences for people. These are decisions taken by computer programs or systems, without involving an employee.
Le Surmelin does not store your personal data for longer than is strictly necessary to realize the purposes for which your data is collected. We use the following retention periods for personal data:
Personal data of interested parties (prospects): Maximum 2 years after last contact. We believe that someone who is interested in our products and services benefits from regular information e-mails.
Personal details of customers. We consider it necessary to retain customer data 5 years after the last delivery. In this way we can always contact our customers for follow-up of their ordered or delivered service or goods and the provision of services or goods in the future. As long as a client-Le Surmelin relationship can exist, we assume that you benefit from receiving newsletters and other information.
Le Surmelin will not sell your information to third parties and will only provide this information if this is necessary for the execution of our agreement with you or to comply with a legal obligation.
